“The foundation of justice is good faith”

We began the year 2012 with Good Faith——this perhaps is what the prosecution team has in their minds when they decided to impeach Chief Justice Renato Corona in the House of Representatives last December 12, 2011. The House members compiled 8 Articles of Impeachment in a fifty-seven (57) page document that was signed by more than one-third of the 285 House Members; a requirement under the Constitution to impeach the Chief Justice without going through plenary debates. The grounds for Corona’s ouster included betrayal of public trust, culpable violation of the Constitution and graft and corruption, mentioned in the Articles of Impeachment was Corona’s “undue closeness” to former President now Pampanga Representative Gloria Macapagal- Arroyo who is under hospital arrest for electoral sabotage.

The Impeachment being a quasi-judicial and quasi-political in nature that is almost but not exactly like a political or judicial proceeding as what Senator-Judge Miriam Defensor-Santiago said in the Impeachment trial is a class of its own. With the alleged 8 Articles of Impeachment the prosecution rested their case withdrawing 5 articles of Impeachment leaving behind 3 Articles namely Articles 2,3 and 7. At present the controversial list of 45 properties allegedly owned by Chief Justice Renato Corona has been cut down to 21 properties including those owned by the Chief Justice , his wife, Cristina Corona and that of their children of legal ages.

As the trial goes on, it is but a surprise for an ordinary Filipino like me to watch the procedure unfolding in my very own eyes. Firstly because it is no less than the Chief Justice of the Supreme Court who heads a co-equal branch of government which represents the rule of law and the proper implementation of Justice is the one being cited to violate the law. Secondly, because it was the President of the Republic through his declarations as seen in the daily headlines that made his intentions evidently clear that is to— Impeach the Chief Justice. Thirdly in this case it was the 188 Honorable Members of the House of Representatives that signed the complaint for the Impeachment case. It was indeed the gathering of the 3 branches of our Democratic form of Government.

Having been said, this Impeachment trial also accompanies with it controversies. Among these are the accusations to the CoronArroyo which sets a 78 percent of court decisions including that of issuing the temporary restraining order in favor of the former president, another is the so-called “Midnight appointee” of the Chief Justice and the controversy that lays in the Hacienda Luisita, a land ownership that remained firmly under the control of the president’s family but later been decided upon by the Supreme Court for redistribution .With this, many curious Filipino people may have developed in their minds confusions with the statements circulating in the cyberspace regarding this trial controversies.

In the past few weeks we have seen the contrast between the defense team, composed mainly of high-caliber and experienced litigation lawyers, and the prosecution team composed mainly of politicians who have spent most of their time in elective public offices and outside the court room. The defense team having Retired Justice Serafin Cuevas as their Lead Counsel is thought to be a “Dream Team”, while the prosecution team headed by Iloilo Representative Neil Tupas, Jr is supposed as the “underdogs” however according to them.” no amount of trial experience can compensate for the defense’s greatest disadvantage: their client Chief Justice Corona”.

With the utterly differences of each panel many years from now when someone in our future look back and ask where were the people of the Republic when they were destroying the judiciary, these men can say “we are the Representatives of the Republic, we were there at the frontline and fought a good fight” hopefully they can say with their heads held high that they have done their very best to save our nation and more our jurisdiction.

May our Senator-Judges be able to read the mind and feel the conscience of the respondent. May they despair the agony of acquitting a guilty man or worst pronouncing the guilt of an innocent person.

Now that this Impeachment trial has long been running as it reached day 34, one cannot deny the fact that this captures the concern of many Filipinos. As the evidence of the Prosecution had already been closed and the Defense panel is now presenting their evidences people cannot stop speculating on how the Senate acting as an Impeachment Court would fulfill their duties that we, the sovereign people of the Republic, has vested upon them. I as a Filipino belonging to the youth sector would want to believe that the Senator-Judges would be impartial and fair.

This story is History in the making we cannot afford another flaw. Let us shed our color biases dismantle the yellow army and let us start working things out. Together like one nation undivided by any shade of hue.
